The "Entity" Challenge: Why Your Trust is Under the Microscope

The core of the Tranche 2 reform is the identification of Beneficial Owners.

AUSTRAC wants to know who the "ultimate" humans are who control or profit from an entity. If you are buying property through a Discretionary Trust with a Corporate Trustee, your lawyer or real estate agent now needs to see:

  1. The full Trust Deed (including all amendments).
  2. Company extract for the Trustee.
  3. Identification for all Directors of that Trustee.
  4. Identification for any individual who owns or controls 25% or more of the entity.
  5. Identification for the Appointor of the Trust.

In the past, you might have provided these to us or your bank. Now, you’ll be providing them to your real estate agent before the "For Sale" sign even hits the lawn.
